Terms of Service

1. Acceptance of Terms

By accessing or using Drafthouse ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access the Service.

2. Description of Service

Drafthouse is a professional screenplay writing platform that provides formatting tools, AI writing assistance, collaboration features, and a script marketplace. The Service is provided on a subscription basis, with certain features available on a free tier.

3. User Accounts

You must create an account to use most features of the Service. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your password and account
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activity that occurs under your account
  • Not share your account credentials with any third party

4. Profile Visibility & Personal Information

By creating an account on Drafthouse, you acknowledge and agree to the following regarding the visibility of your information:

All accounts: Your profile image and @handle are publicly visible to other users of the platform. Personal information such as your name, email address, and other registered information is private by default and will only be visible to other Drafthouse users if you choose to make it public through your profile or account settings.

Actor accounts: By registering as an Actor, you agree that your @handle, all portfolio images you upload, and your physical characteristics (such as height, age range, gender, ethnicity, hair color, eye color, and build) will be publicly visible to all users of the platform, including through the Discover actors directory. This information is essential to the purpose of the Actor account and cannot be made private while maintaining an Actor account.

Producer accounts: By registering as a Producer, you agree that your profile image, @handle, and any company information you provide will be publicly visible to other users of the platform. This visibility helps writers and other professionals identify and connect with you on Drafthouse.

5. Subscription Plans & Billing

Drafthouse offers Free, Pro, Team, and Producer subscription tiers. Paid plans are billed monthly or annually as selected at checkout.

  • You authorize us to charge your payment method on a recurring basis for your selected plan
  • Prices are subject to change with 30 days' notice
  • Refunds are issued at our discretion for unused periods of annual subscriptions
  • Canceling a subscription will maintain access until the end of the current billing period
  • Failed payments may result in downgrade to the free tier

6. Intellectual Property

Your content: You retain full ownership of all scripts, characters, notes, and other content you create using the Service. By using the Service, you grant Drafthouse a limited, non-exclusive license solely to provide the Service to you (e.g., storing and displaying your content).

Our content: The Service, including its design, code, trademarks, and branding, is the exclusive property of Drafthouse. You may not copy, modify, or distribute any part of the Service without our written consent.

7. Script Marketplace

The Discover marketplace allows writers to list scripts for discovery. By publishing a script to the marketplace, you:

  • Confirm you are the original author or have the right to list the work
  • Grant Drafthouse a non-exclusive license to display the script metadata, logline, and synopsis
  • Understand that Drafthouse does not broker, negotiate, or facilitate any transaction
  • Remain solely responsible for any agreements made with interested parties
  • May unpublish your script at any time

8. Community Forum

Drafthouse provides a community forum where users can create groups, post discussions, comment, and interact with other members. By participating in the forum, you agree to the following:

  • Treat all members with respect — harassment, hate speech, personal attacks, and discrimination of any kind are strictly prohibited
  • Do not post spam, advertisements, or promotional content unrelated to the screenwriting community
  • Do not impersonate other users, public figures, or Drafthouse staff
  • Do not share another person's private information without their consent
  • Respect group-specific rules set by group moderators and administrators
  • Do not use the forum to distribute malware, phishing links, or any harmful content
  • Content posted to the forum may be viewed by other users — do not share confidential or sensitive material you do not want others to see

Group owners and administrators may moderate content within their groups, including removing posts, comments, and members. Drafthouse reserves the right to remove any forum content and to take action against any user account at our sole discretion.

9. Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Upload content that infringes on third-party intellectual property
  • Transmit harmful, offensive, abusive, or threatening content, including through the forum, messages, or any other feature of the Service
  • Harass, bully, intimidate, or threaten other users
  • Attempt to gain unauthorized access to the Service or other accounts
  • Use automated tools to scrape, crawl, or extract data from the Service
  • Resell or sublicense access to the Service without written permission
  • Circumvent any moderation, blocking, or banning action taken against your account
  • Create multiple accounts to evade a ban or suspension

10. AI Features

Drafthouse uses third-party AI services (including OpenAI) to power writing assistance features. AI-generated content is provided "as is" and may be inaccurate, incomplete, or unsuitable for your purposes. You are solely responsible for reviewing and using any AI-generated content. We do not claim ownership of AI-generated output produced using your prompts and screenplay content.

11. Enforcement & Termination

Drafthouse reserves the right to investigate, warn, suspend, or permanently ban any user account at our sole discretion, with or without prior notice, if we determine that the user has violated these Terms, any applicable law, or any community guidelines. This includes, but is not limited to:

  • Violating the Community Forum rules or group-specific rules
  • Engaging in behavior that is harmful, abusive, or disruptive to other users or the Service
  • Posting content that is illegal, infringing, or in violation of these Terms
  • Attempting to circumvent any enforcement action, including ban evasion through new accounts
  • Any other conduct that we reasonably consider to be inappropriate or detrimental to the community

Enforcement actions may include removal of content, temporary suspension, permanent banning from the forum or specific groups, or full account termination. Upon termination, your right to use the Service ceases immediately. You may export your scripts at any time before termination. We are under no obligation to provide a refund for any unused subscription period following an enforcement action resulting from a violation of these Terms.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

13. Limitation of Liability

To the fullest extent permitted by law, Drafthouse shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of data, revenue, or profits. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.

15. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by email or by posting a notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
